The
defendant is sentenced as provided in pages 2 through 6 of
this judgment. The sentence is imposed pursuant to the
Sentencing Reform Act of 1984.
Counts
Two, Three, Four, Nine, Ten, Eleven and Twelve of the
Indictment are dismissed on government's motion.
IT IS
ORDERED that the defendant must notify the United States
Attorney for this district within 30 days of any change of
name, residence, or mailing address until all fines,
restitution, costs and special assessments imposed by this
judgment are fully paid. If ordered to pay restitution, the
defendant shall notify the court and United States Attorney
of any material change in the defendant's economic
circumstances.
IMPRISONMENT
The
defendant is hereby committed to the custody of the United
States Bureau of Prisons to be imprisoned for a total term of
NINETY-TWO (92) MONTHS as to Count One of the Indictment with
credit for time served as calculated by the Bureau of
Prisons.
The
Court recommends to the Bureau of Prisons:
1.
1st choice of incarceration - Schluykill, PA
2.
2nd choice of incarceration - Ottisville, NY
3. 500
hour substance abuse counseling for heroin and other drugs.
4.
Medical examination for gallstones and related problems.
Defendant needs diet for same.
5.
Vocational education in electrical trade, welding, HVAC,
refrigeration, plumbing, mechanics, small business
administration and computers related to trades.
6.
Counseling regarding better selection of associates.
